Three years imprisonment in death caused due to accident

JAMMU, Feb 13: Observing that “a deterrent punishment is required in road accident cases”, a Jammu court has awarded three years imprisonment to a car driver.
The brief facts of the case are that on 02.08.2009 at about 4:30 pm police station Nowabad received information that one Kamal Gupta S/o Bansi Lai Gupta R/o Janipur who was going on his scooter no. JK02B-1627 along with his wife Sapna Gupta and daughter Gunjan Gupta from Bikram Chowk to Janipur has met with an accident at 4:15 pm on flyover near Jewel Chowk with Maruti Car No JK02G-8191 coming from Jammu City side which was driven by Anil Singh Jamwal R/o Nanak Nagar. The accident took place due to high speed, negligence and rash driving of car driver. The accused could not control his vehicle and crossed the road divider and hit the scooter on the other side. Due to accident Kamal Gupta and his wife Sapna Gupta got seriously injured however daughter Gunjan died on spot. On this report police registered FIR No. 102 u/s 279/337/304-A RPC and started investigation. During the investigation Kamal Gupta also died. Sub-Judge Jammu Pawan Kumar Sharma after hearing APP Puja Nijhon appearing for the prosecution observed that Anil Singh Jamwal is convicted U/S 279/RPC with the imprisonment of six months and fine of Rs 1000. The accused is also sentenced to imprisonment for 6 months U/S 337/RPC. The accused is further sentenced to imprisonment of one year U/S 338/RPC and a fine of Rs 1000. The accused is also sentenced as punishment of three years imprisonment and fine to the tune of Rs 3000 U/S 304-A/RPC. The fine amount if paid by the accused shall be given to survivor Sapna Gupta and in the event of non-payment of fine the accused shall have to undergo further imprisonment of six months. All the sentences shall be run concurrently. The accused who was present in the Court taken into custody and shall be sent to serve the sentence in District Jail Ambphalla Jammu. JNF
