Forest Deptt Poonch retrieves encroached land, develops nursery on it
Gets cancellation of illegal revenue record

JAMMU, May 4: Forest Department Poonch succeeded in retrieving encroached land of the department and developed a forest nursery on it. Moreover all illegal entries in revenue records were cancelled in this connection.
Sources told Early Times that the encroached land under Khasra No. 764 Village Nar has been recorded as Ghair Mumkin Jungle in RoR 1961-62 and there used to be a very old nursery of social forestry department in late eighties and nineties.
They further said that Mutation no. 297 (under 394-C) was attested in favour of Mohd Ikhlaq Khan for an area measuring 10 Kanal 2 Marla in Khasra No. 764, Comp. 155/M Village Nar in 2000 in violation of statutory provisions & mandatory instruments of Revenue & Forest Act.
“Encroacher approached Sub-Judge Court Poonch against Chief Secretary & Forest department (defandants) for declaration & permanent prohibitory injunctions. He claimed suit land measuring to 10 Kanals 2 Marla situated village Nar Tehsil Mendhar survey/Khasra no. 764 min (Kap). He prayed that he may be declared owner of the suit land and defendants may kindly be directed not to interfere in the suit property. Patwari Halqa Nar misled the Sub-Judge Court by proving wrong and incomplete information,” they informed.
They further said that court said that case has already been decided by Revenue Authority vide order 394/C but fact of the matter is that Collector Agrarian (ACR) or higher authorities is competent authority to issue permission to enter any decree in revenue records but in this case decree sheet was entered in revenue records without the permission of Collector Agrarian (ACR) or higher authorities.
An appeal was filed against Mutation no. 297 for land in the Court of Asst. Commissioner (Rev) Poonch. Asst. Commissioner (Rev) Poonch had passed order to maintain status-quo on spot in respect of land under appeal and resulting appeal remained undisposed for 6 years.
Then Divisional Forest Officer has requested Asst. Commissioner (Rev) Poonch to issue order for cancellation of illegal Mutation no. 297 on forest land for the purpose to decide the title of land. The DFO also requested Deputy Commissioner Poonch for cancellation of illegal mutation no. 297 as Khasra no. 764 is forest land recorded in RoR of 1961-62.
After continuous and vigorous efforts, the encroached forest land of worth of crores was secured & fence in presence of executive magistrate and a good quality of nursery was established against all odds, on prime location. Moreover, Forest Department informed Revenue Department not to interfere in working of forest department by issuing any directions or order beyond latter’s jurisdiction.
