Formation of new Backward Classes Commission unconstitutional: AIBCU

JAMMU, June 11: A meeting of the All India Backward Classes Union (AIBCU) held here today under the directions of its president Abdul Majid Malik through telephonic calls.
In the meeting, AIBCU General Secretary Prof Kali Dass informed the house about the action taken in two matters, one for the implementation of central govt order dated 13th of February 2014 which reads that any board/committee constituted must have one member from OBCs besides one member of SC/ST, one member from minority communities and one lady member should be included which is also applicable in banks and public enterprises.
Besides the house was also informed that a strong notice has been taken against unconstitutionally constituted Backward Classes Commission in J&K UT on 19th of March 2020 which is meant for Backward Classes but the chairman and its two appointed members are all non-OBCs, who have nothing to do with the Backward Classes.
It was further informed that the constituted commission is not in accordance with the act of the Backward Classes according to which there must be one chairman, two members preferentially from the Backward Classes, one educationist having adequate knowledge of Backward Classes problems, one person of the rank of secretary to the govt with at least two years experience with adequate administrative knowledge and a secretary to the commission of additional secretary level having at least two years experience.
The memebrs were told that a letter protesting the formation of new commission has also been sent to National Commission for Backward Classes New Delhi, Ministry of Social Justice and Empowerment and to the Prime Minister.
The commission must have been constituted by the social welfare department instead of law department having no concern with the constitution of the commission, the meeting added.
