Six acquitted in murder case

JAMMU, June 27: Principal Sessions Judge Jammu Sanjeev Gupta acquitted six persons facing trial in murder case, with the observations that the FIR is an outcome of manipulation, deliberation and concoction, which makes the prosecution story suspicious from its inception.
Principal Sessions Judge Jammu Sanjeev Gupta after hearing Advs Prince Khanna and Zenab Shamas Wattali for the accused persons namely Darshan Lal, Rohit Kumar, Sat Pal, Ravinder Kumar, Ajay Kumar and Ranjeet Singh whereas Special Public Prosecutor EA Tak for the State, on the basis of discrepancies and lacunae pointed above in the evidence on record, it becomes clear that the prosecution has failed to prove its case against the accused, who are acquitted of the charge. Accordingly, prosecution case is dismissed and accused are acquitted and directed to release the accused persons from the custody if not required in any other case.
Briefly put, prosecution story is that on 23.03.2015 Hussain Mir lodged a written report to the police station R S Pura, to the effect that he is a resident of Jora Farm, Tehsil Suchetgarh and owes number of cattle. At about 1.30 a.m in the night he woke up and found one ‘he buffalo’ missing from the herd due to which he sent his sons Fiaz Ali (hereinafter called deceased) and Mohd Rafi) in search of the buffalo who on reaching Jora Farm near Tube Well No:1 found accused persons namely Darshan Lal, Rohit Kumar, Sat Pal, Ravinder Kumar, Ajay Kumar and Ranjeet Kumar sitting in a room, armed with Tokas and Gandasas and on seeing his sons, accused persons challenged them and after catching hold of them inflicted blows of Tokas and Gandasas on the person of the deceased in order to do away with his life, who got seriously injured and died on the spot. It is further alleged that accused persons after committing the crime threw the body of deceased in a watery ditch. However, PW-4 somehow managed to save his life and succeeded in giving slip to the accused who narrated the entire episode to him. On this report case FIR No: 48/2015 for offence u/ss 302, 147,148,149, 34 RPC & 4/25 A Act was registered by Police Station RS Pura and after completion of the investigation presented challan. JNF
