DB directs Law Deptt to act immediately on Registrar General's communication
Petition regarding dearth of staff in J&K Courts

JAMMU, July 16: In a petition filed by Joginder Singh, Bench Secretary of the High Court, regarding dearth of staff at various level (i.e.) High Court and District Courts, pay anomaly in respect of officers and staff and promotional avenues to Law Graduate Readers of the High Court, a Division Bench (DB) of Jammu & Kashmir High Court comprising Justice Dhiraj Singh Thakur and Justice Puneet Gupta after hearing petitioner in person, directed Law Department to act immediately on the said communication dated 06.07.2021 by Registrar General, so that the immediate need of the High Court is met with at the earliest.
DB further observed that another communication bearing No. 32973/RG/GS dated 07.07.2021 has also addressed to the Secretary to the Government, Department of Law, Justice and Parliamentary Affairs, UT of J&K, in regard to which the official respondents are expected to take necessary steps as has been requested in the aforementioned letter and directed copies of the aforesaid communications be handed over to Aseem Sawhney, AAG for facilitating an appropriate response in regard to the action taken in that regard.
When the petition came up for hearing, the Division Bench observed that the High Court was considered and a communication dated 07.04.2021 addressed to the High Court, requesting for reconsideration and rationalization of the proposals for creation of posts and exploring the possibility of phasing out the said creations. In this regard, it appears that a communication dated 06.07.2021 was addressed by the Registrar General of the High Court, in which the proposal with regard to the creation of the posts in a phased manner has been accepted. Along with communication dated 06.07.2021, an Annexure-A was also appended suggesting the phases in which the posts would be created. The official respondents need to act immediately on the said communication dated 06.07.2021, so that the immediate need of the High Court is met at the earliest. —JNF
