No passport to govt employees till vigilance clearance another arbitrary decision: CPI(M)

SRINAGAR, Sept 17: Senior CPI(M) leader Mohammad Yousuf Tarigami on Friday said that the recent orders by J&K administration 'mandating vigilance clearance for government employees to get passport and termination of employees involved in anti-national activities' is another arbitrary decision, which needs to be rolled back immediately.
"Denying anyone a passport based on a vigilance case cannot be a substitute for being found guilty in a court of law. One of the most sacred principles of the justice system is that a person is innocent until proven guilty. How can the government deny a passport to an employee on mere registration of a case by vigilance?" Tarigami said on Friday.
The senior CPI (M) leader said that it seems the J&K administration is on a mission to target its employees and keep them under constant fear. "This has and will adversely affect the work in government departments. If somebody is violating the law he must be dealt with accordingly, but an arbitrary approach is not good in a democratic country," he said.
Tarigami said earlier this year government employees were terminated without being given a chance to defend themselves which is their constitutional and legal right, adding it is quite arbitrary. "On the ground there is an atmosphere of fear prevailing everywhere," he said.
"The autocratic orders issued by the administration one after another against the interests of people of Jammu and Kashmir. Instead of issuing such orders, the government must ensure that people in the region, who are suffering immensely, for the last more than two years are provided with some succor," he added.
The government in an order issued on Thursday warned employees to face termination from service for their involvement in anti national activities or association or sympathy with persons involved in any act of sabotage, espionage, treason, terrorism, subversion, sedition, secession, facilitating foreign interference, incitement to violence or any other unconstitutional act.
The government has constituted Union Territory (UT) Level Screening Committee (UTLSC) for the purpose vide Jammu and Kashmir Civil Services (Verification of Character & Antecedents) Instructions, 1997, notified vide Government Order No.191B-GAD of 1997 dated 09.12.1997 as amended from time to time, for its decision. The UTLSC has been authorized to conduct periodic verification of character and antecedents of Government employees and recommend action.
The order further said that involvement of an individual's immediate family, persons sharing residential space with the employee to whom he or she may be bound by affection, influence, or obligation or involved in any of the acts, directly or indirectly, having potential of subjecting the individual to duress, thereby posing a grave security risk. "Failure to report relatives, persons sharing residential space or associates who are connected with any foreign Government, associations, foreign nationals known to be directly or indirectly hostile to India's national and security interests and failure to report unauthorized association with a suspected or known collaborator or employee of a foreign intelligence service," it added.
In a separate order, the administration said that no passport will be issued to any Jammu and Kashmir government employee without the clearance from Vigilance. "The J&K Anti Corruption Bureau (ACB) has also brought into the notice of the government the present mechanism for issuance of passport to government employees without obtaining requisite vigilance clearance results in the issuance of passport to those employees against whom there are cases pending with vigilance. Thus, there is an urgent necessity to instruct all the departments to issue No Objection Certificate (NOC) for issuance of passport on the basis of vigilance clearance only," it added.
