Court rejects pre-arrest bail plea of fraudster who duped Rs 67 lakh

JAMMU, June 6: Additional Sessions Judge Kathua, Kamlesh Pandit has rejected the pre-arrest bail plea of Vijay Kumar R/o Salalpur, Kotpunnu in Kathua who duped Rs 67 lacs on the pretext of sale of land.
The police case said that complainant lodged a written complaint with the concerned police station for registration of case against the accused person for fraudulently cheating them with regard to purchase of land to the tune of Rs. 67 lakhs. The police report said that the complainant party had purchased 66 kanals of land at village Chabba Chak from accused person @ 1.5 lakh per kanal regarding which Rs. 67 lakhs were paid in advance.
It said that 10 kanals of land were got registered in favour of complainant party but possession was not handed over to them and thereafter accused person agreed to repay the amount but in this connection cheques in the name of complainant party were issued when he had no amount in the bank. On this complaint case under FIR 103/2022 was registered for the commission of offence u/s 420 IPC and investigation is going on.
The court after hearing both the sides observed that the accused person has agreed to sell the land which he was not possessing for a hefty consideration and had therefore guilty mind from the very inception. The exceptional jurisdiction of this court for grant of pre arrest bail is for those persons who have regard for the law and not for those who disregard law and take law into their own hands like the case at hand.
More so, the investigation is in initial stage and the release of the accused persons at this stage would definitely cause dent in the investigation and also there is every apprehension that accused/applicant may repeat the offence. With these observations court reject the pre-arrest bail application.
