Driver accused of rash driving awarded rigorous imprisonment for three years

JAMMU, July 5: Sub-Judge Katra Manoj Parihar convicted accused Sohan Singh alias Sonu S/o Jagdish Singh R/o Kundrorian, Katra Tehsil Katra, Reasi in a case involving offences for causing death by rash and negligent driving and endangering human life and awarded three years imprisonment.
The accused allegedly caused the death of five passengers who died while driving matador in a rash and negligent manner as a result of which an FIR was registered and investigation followed. On 10-12-2014 a report was received from reliable sources that one matador 55I2/JK02R, driven rashly and negligently after loading passengers from Reasi towards Katra. At Balini near railway bridge Katra the driver could not control the vehicle and it met with an accident falling 50-60 meters from road in Balini nallaa. 15-20 passengers in the vehicle got injured, out of which five passengers died.
Sub-Judge Katra observed that in light of the evidence so produced by the prosecution and documents that accused was negligent in driving the vehicle. The accused acted without consciousness while using the phone and taking (he vehicle towards the wrong side and causing an accident, thereby he was acting without consciousness that the illegal and mischievous effect will follow and he had not taken/exercised the due caution incumbent upon him and if he had he would have had the consequences.
The imputability arises from the negligent of the civil duty of the circumspection, the circumspection which was absent in this case on the part of the accused. The negligence driving by the accused is a breach of duty imposed by law upon him. As he being driver of the passenger/matador was required to be a more careful driver of other vehicles, because he is taking care of human lives. Although there has come some evidence that the road was on slope and there were pits that would not. With these observations, the Court awarded 3 years imprisonment.
