MJR-47 demands political empowerment of POJK DPs

JAMMU, July 20: Right from the appointment of Delimitation Commission, we, the MJR-47 took up the issue for allocation of assembly seats kept reserved for POJK residents to DPs of 1947 from POJK for their political Empowerment . The Commission replied saying that the law does not provide for this .
We contested their contention by quoting the clause 14(3) and 14(4) of the JK Reorganization Act 2019, governing the issue and clearly defines the elected strength of the assembly which had been reduced unjustifiable by deducting the seats kept reserved for POJK voters still living in POJK.
We presented our case before the Commission in July 2021, at Jammu,and again in April 2022 when the Commission held an open discussion at Jammu. We presented the case and convinced the Commission to open the law book and looked through the articles, and the Hon'ble Chairperson assured to have a fresh look into the matter.
Finally it submitted its report recommending "SOME" assembly seats for POJK DPs without specifying the number as has been clearly spelled out for valley migrants.
Now the case is with the GOI and the DPs request that unlike the previous govts, the present govt should do justice to the DPs by allocating at least 8-10 seats in proportion to the population displaced from POJK areas illegally Occupied by Pakistan after Oct 1947 and since living in India .
The DPs were the saviors of the state and had sacrificed more than 40,000 lives fighting the raiders and faced the genocide to thwart the battle to capture the State by the Pak army in the guise of the tribal raiders. Inspite of this sacrifice, the DPs of 1947 have been deprived of their political rights as given by the constitution resulting in their long suffering all these years . MJR fails to under stand that when valley migrants have their marked constituency segments then what is the justification to award two extra assembly seats to them and if so then similarly why not have given specific number of seats to DPs as proportionate to their voters strength to mitigate their long pending grievances.
The total number of assembly seats for UT J&K have been increased from 100/75 to 107/83 and now again to 114/90 but the proportionate seats for POJK also need to be increased proportionately. Thus the increase in the share for DPs is also justified to be increased .
As such MJR-47 strongly demands proportionatat increase in assembly seats for DPs to at least 10-ten be allocated for DPs of 1947 from POJK to commensurate with the increased number of DP voters today and give them their political rights as ensured by the constitution.
