Court awards life-imprisonment in murder case of employee of Dabur India

JAMMU, July 28: Principal Sessions Judge Samba Sonia Gupta today awarded life-imprisonment to Kaleshwar Hondsa an employee of Dabur India who murdered his senior Suresh Chander Sharma.
On 1-11-2012 S.K. Sabapathy, Unit Manager of Dabur India Ltd., made a written complaint to SHO, Police Station, Bari Brahmana that one worker namely, Kaleshwar Hondsa, age 32 years, R/o. Harin Gohal, Tehsil and District Dumka, Jharkhand, started hitting around with an iron angle and the other workers tried to stop him, but he kept on hitting and hit one of their officials Suresh Chander Sharma, aged 48 years R/O Sawai, Madhopura, Rajasthan, on his head resulting into his death; that he also hit another person namely, D V Rai of Himachal Pradesh inflicting head injuries.
On receipt of aforesaid written communication, a case was registered at Police Station, Bari Brahmana vide FIR 108/2012 for the commission of offences punishable U/Ss 302/307 RPC and investigation was assigned to SI Ramesh Chander. During investigation, it was found that Hondsa was asked to attend the directions with regard to rules and regulations in a line, but he did not oblige and the deceased, who was an official of the company, scolded him who felt humiliated and developed intention that in case the deceased would repeat it, he would kill him.
On 1-11-2012, when the deceased deputed Dharam Veer Rai, Welfare Officer of Dabur India to ask the workers to assemble for their medical check up at 1:30 PM, who informed all the workers to follow the directions, however, except Hondsa, all the workers acted upon his directions. The deceased scolded him as to why he had not lined up, where on he got annoyed and picked up a piece of iron angle and hit Suresh on his head, who fell down on the ground bleeding and Hondsa gave him repeated blows. Sanjay Bhasin, another official of the company, raised hue and cry. On hearing the cries, Ajit Kumar, Pankaj Sharma and Dharam Veer Rai came on spot. Dharam asked Hondsa as to what he was doing and tried to snatch iron angle from him, but he also hit him on his head causing him injuries.
The assailant was overpowered and Suresh succumbed to his injuries on spot. On completion of investigation, it was concluded that Hondsa (hereinafter called 'accused') had committed offence punishable U/Ss 302/307/323 RPC and a charge-sheet was laid against him for the commission of aforementioned offences.
Principal Sessions Judge Samba observed that convict is a young person and the imposition of sentence for life imprisonment u/s 302 RPC would serve the interest of justice and that the present case does not fall in the category of rarest of rare case so as to the imposition of death sentence, which is of exceptional nature. Keeping in view the age of the convict/accused and considering the contention of learned Amicus Curaie about the crime, I think this case does not fall in the category of rarest of rare case.
Accordingly, convict was sentenced to undergo imprisonment for life and a fine of Rs. 10,000 for offence u/s 302 RPC and in default of payment of fine he shall undergo further imprisonment for six months. He is further sentenced to undergo imprisonment for six months for offence u/s 323 RPC. Both the sentences shall, however, run concurrently. The sentence of imprisonment for life, however, shall be subject to confirmation by High Court.
