| Expedite release of funds to construct Mendhar court building: HC to Admin | | | Early Times Report
Jammu, Apr 10: In a PIL filed by Bar Association, Mendhar highlighting the dilapidated condition of the Munsiff Court Building, a Division Bench of Jammu & Kashmir and Ladakh High Court Comprising Justice Tashi Rabstan and Justice Rajesh Sekhri disposed of the PIL with a direction to the official respondents to expedite the matter for accord of administrative approval and release of funds for construction of building of court of Munsiff Mendhar along with advocates’ chamber at the earliest.
When the PIL came-up for hearing, the Division Bench observed that in compliance to the directions passed by this Court the communication dated 30.12.2021 was forwarded DPR for construction of Court Complex (G+3) at Mendhar, Poonch for an amount of Rs.1234.60 lakhs to the Development Commissioner Works (DCW) for technical vetting. However, the same was returned by the Development Commissioner Works, Public Works Department on 25.01.2022 with the request to clear certain shortcomings.
Accordingly, the High Court vide communication dated 25.01.2023 returned the rectified DPR for an amount of Rs. 1158.48 lakhs and requested the concerned for accord of administrative approval and release the funds for undertaking the subject work. The respondents herein have accordingly forwarded the rectified DPR again to the Development Commissioner Works (DCW) on 22.02.20232 for technical vetting and response of which is still awaited.
The DB further observed that since the Department of Law, Justice and Parliamentary Affairs has already forwarded the rectified DPR to the Development Commissioner Works, Public Works Department on 22.02.2023 for technical vetting, response of which is still awaited, thus, we deem it appropriate to dispose of the instant PIL with a direction to the official respondents to expedite the matter for accord of administrative approval and release of funds for construction of building of court of Munsiff Mendhar along with Advocates’ chamber at the earliest.
