High Court emphasizes integrity requirement for Police Force Members | | | Early Times Report JAMMU, May 23: In a significant judgment, a Division Bench of Jammu & Kashmir and Ladakh High Court (Srinagar Wing) comprising Chief Justice N. Kotishwar Singh and Moksha Khajuria Kazmi underscored the utmost importance of integrity for every member of the police force. The bench expressed that candidates aspiring to join the police force must possess exceptional integrity, as any involvement in fraud during the initial stages of service raises concerns about their potential as responsible police officers. The case pertained to Farooq Ahmed Parray, whose selection and appointment as a Police Constable were allegedly revoked during his probation period due to the submission of a fake driving license to secure additional points during the selection process. After hearing arguments from both sides, the Division Bench emphasized that the scrutiny of candidates' submitted credentials is an integral part of the selection and appointment process. If it is discovered that a candidate presented fraudulent documents, the natural consequence would be the cancellation of the selection and appointment. In such cases, the authorities are not obligated to conduct an inquiry or provide a hearing opportunity to the petitioner. In dismissing the appeal, the Division Bench stated that the petitioner's selection and appointment were canceled due to his involvement in fraud, not due to a mere discrepancy in scoring. It was noted that the petitioner's fraudulent actions were a serious matter, and he did not deserve to continue in service or hold a position within a disciplined force. The High Court further emphasized that aspiring police personnel must exhibit exceptional integrity from the outset of their service. Taking a lenient view toward fraud committed during the initial stages would be contrary to the expectations placed on police officers. Additionally, the appellant had submitted a sworn affidavit during the selection process, acknowledging that his services would be liable for termination and criminal prosecution if any of his claims or certificates were found to be invalid at any stage. The judgment serves as a reminder of the critical role integrity plays in maintaining the credibility and effectiveness of the police force. |
