High Court seeks information on State Commission for Child Rights Protection

JAMMU, May 23: A Division Bench of the Jammu & Kashmir and Ladakh High Court, comprising Chief Justice N. Kotishwar Singh and Justice Atul Shreedharan, has directed the authorities to provide information on the steps taken for the constitution of the State Commission for the Protection of Child Rights.
During the hearing of a Public Interest Litigation (PIL), the Bench noted that Section 44 of The Protection of Children from Sexual Offences Act, 2012 mandates the monitoring of the effective implementation of the provisions of the Act by the concerned State Commission for the protection of child rights.
It was brought to the attention of the Court that no such Commission has been constituted in the Union Territory of Jammu and Kashmir as well as in the Union Territory of Ladakh.
The Bench observed that the non-constitution of the Commission, considering its statutory role in the effective implementation of the Act, would be a serious lapse on the part of the authorities concerned.
Before issuing specific directions in this matter, the Bench has requested the authorities to provide details of the steps taken for the constitution of the Commission.
The case will be further heard as per the schedule.
