J&K high court grants 6 weeks to CBI in Patnitop illegal construction case

Jammu, Aug 4: The Division Bench of Jammu & Kashmir and Ladakh High Court, comprising Chief Justice N Kotishwar Singh and Justice Wasim Sadiq Nargal, granted six weeks to Senior Additional Advocate General (AAG) Monika Kohli, representing the Central Bureau of Investigation (CBI), to confirm whether the required sanction has been obtained from the concerned authority for filing the charge sheet in the illegal construction case at Patnitop.
The PIL pertains to the issue of illegal construction activities at Patnitop, and on December 31, 2019, the Division Bench had directed the Director of CBI to conduct an in-depth inquiry into various aspects related to the encroachment on forest land and other public land, illegal change of land use, misuse of land in violation of permitted use, and raising of illegal constructions.
The Court also sought to fix the responsibility of individuals who were duty-bound to take action and hold them accountable for any negligence in enforcing the law.
During the recent hearing, the Court sought clarification from the CBI counsel regarding whether the necessary sanction for filing the charge sheet had been obtained from the concerned authority. If not, the CBI counsel was directed to provide reasons for the delay in obtaining the sanction.
The illegal construction case at Patnitop has been a matter of concern, and the High Court is closely monitoring the progress of the investigation.
The Court aims to ensure that the matter is thoroughly investigated and any responsible parties are held accountable for their actions or inactions related to the illegal constructions and land misuse.
The Court’s intervention in the PIL is crucial in addressing issues related to unauthorized constructions and safeguarding public land from encroachment.
The six-week extension granted to the CBI counsel allows for a detailed review of the status of the investigation and compliance with the necessary legal requirements before proceeding with the charge sheet filing.
