Court awards life-term to couple for murder over sale-purchase of vegetables

JAMMU, Aug 30: Principal Sessions Judge Udhampur Haq Nawaz Zargar today awarded life imprisonment to Jolli Ram and his wife Thakri Devi facing trial in murder of one Mohan Lal over the issue of sale-purchase of vegetables.
Prosecution case is that on 24.07.2016 at 3 am, SI Manoj Kumar recorded the statement of Soma Devi at Chenani Hospital wherein she had stated that at about 10.30 in the night, accused Joli Ram and his wife Thakri Devi with common intention on the basis of enmity with regard to sale purchase of vegetables called the deceased Mohan Lal outside the house and in presence of complainant Soma Devi and Ratni Devi W/o Mohan Lal hit the deceased on head with Axe and killed him. The deceased was taken to hospital by them along with other persons from the place of occurrence where doctors have declared him as dead. On the basis of this report, FIR No. 75 /2016 under section 302, 34 RPC came to be registered against the accused persons and investigation commenced.
Principal Sessions Judge Udhampur Haq Nawaz Zargar after hearing PP Koushal Kotwal for the UT whereas Adv Gian Khajuria for the accused persons, observed that the case does not fall within the rare of the rarest cases and thus the extreme penalty should not be imposed. It is perfect case where the saying is appropriately applied that "the fence eats the crop". The convict number 1 who was given land by the mother of the deceased for the purpose of safety, affection, love so that they all will stay in the nearby vicinity had killed her only son instead of protecting his sister and her family. The convicts had not thought for a second as what would happen to the mother, wife and minor kids of the deceased when they committed this gruesome and unpardonable offence. Keeping in view the above facts and circumstances into consideration the sentence of life imprisonment will be most appropriate punishment to be passed against the above named convicts in this case, so far as the commission of the murder of deceased by the convicts. Accordingly, convict namely Jolli Ram S/o Teju R/o Moori Naal Bashat, Tehsil Chenani and District Udhampur is punished for commission of offence under section 302 RPC read with section 34 RPC and is sentenced to undergo life imprisonment, similarly convict Thakri Devi W/o Joli Ram R/o Moori Naal Bashat, Tehsil Chenani and District Udhampur is punished for commission of offence under section 302 RPC read with section 34 RPC and is sentenced to undergo life imprisonment. Both the convicts are also sentenced with fine of Rs. 50,000/- each and the same shall be paid as compensation to the kids of deceased Mohan Lal.
