Driver gets 2-year imprisonment for killing minor

Jammu, Sept 4: City Judge Jammu Pooja Raina today awarded 2 years imprisonment to Sham Bakshi who killed minor child by his car.
According to the police case that on April 16, 2011 P/S Bakshi Nagar received an information that a car bearing No JKS 4200 driven by accused Sham Bakshi negligently, carelessly and rashly was coming towards Bakshi Nagar and on reaching Baby caterers Rehari could not control his car and hit a scooty which was driven by Arun tendon and caused an accident. Due to accident, Arun tendon and his three years son were injured and as a result Adhyan Tandon age 3 years died and accused fled away from the sopt. On this police registered a case and after completion of investigation challan was presented.
City Judge Jammu Pooja Raina after hearing Special PP Aseem Sawhney for the UT, observed that since the convict is now aged more than 76 years and was not a driver by profession, therefore, the said consideration also weighs in the mind of the court while awarding sentence as a mitigating circumstance. Accordingly, the convict is sentenced to a simple imprisonment for a period of three months and a fine of rupees one thousand for commission of the offence under section 279 RPC Further, the convict is sentenced to a simple imprisonment for a period of two years and fine of Rupees two thousand, for the commission of offence under section 304A RPC. In default of payment of fine, the convict shall further undergo simple imprisonment for a period of one month. Both the sentences however, shall run concurrently. (JNF)
