TS Wazir murder case: Delhi HC stays order discharging 3 accused

New Delhi, Oct 24: The Delhi High Court has stayed the discharge of three accused from charges in the murder case of National Confrence leader Trilochan Singh Wazir.
Delhi Police had approached the High Court against the discharge of the three accused and mentioned the matter before the Chief Justice.
Justice Vikas Mahajan on Saturday after hearing the revision of Delhi Police stayed the operation of the discharge of three accused namely Balbir Singh alias Billa, Rajinder Chaudhary alias Ganja and Sudershan Singh Wazir.
The High Court has issued notice to the respondents and sought a reply. The next date of hearing is December 13, 2023.
Delhi’s Tis Hazari Court had recently discharged three accused in the murder case of the Natioanal Conference.
One accused has been charged with the offence of murder and another was charged with the offence of destruction of evidence.
Additional Sessions Judge (ASJ) Hem Raj on October 20, 2023, discharged accused Balbir Singh alias Billa, Rajinder Chaudhary alias Ganja and Sudershan Singh Wazir from all the offences in this case.
However, the court charged accused Harmeet Singh for the offence under Section 302 IPC.
Accused Harpreet Singh Khalsa has been discharged from the offences under Sections 302 IPC r/w 120 B IPC, however, he has been charged with the offence under Section 201 (Destruction of evidence) IPC and 174A IPC.
This case pertains to the homicidal death of Trilochan Singh Wazir who died due to a single gunshot injury on his head. Wazir was a former MLC from Jammu and Kashmir. He was allegedly murdered in Delhi in September 2021.
Delhi Police had filed a charge sheet against the accused persons namely, Harmeet Singh, Harpreet Singh Khalsa, Rajinder Chaudhary, Balbir Singh and Sudarshan Singh Wazir for alleged offences under sections 302/201/174A/120B/34 IPC.
Delhi Police have filed four charge sheets including three supplementary charge sheets. The first chargesheet was filed against the accused Harmeet, Rajinder and Balbir.
In the first supplementary charge sheet, the Forensic Science Laboratory (FSL) result was filed. Accused Khalsa was forwarded for trial through a second supplementary charge sheet.
Accused Sudarshan has been forwarded for trial by way of a third supplementary charge sheet. In the third supplementary charge sheet, it is stated that sufficient evidence has come against Harmeet, Khalsa, Rajinder, Balbir and Sudarshan.
However, the investigation against Harjinder Singh Raina and Jagpal Singh is still continuing, the court noted.
As per the complaint, on receipt of information about the foul smell emanating from a flat situated on the second floor of a building in Basai Darapur, the police of PS Moti Nagar reached the spot to check. The said flat was under the tenancy of accused Khalsa and owned by Kulbhushan who opened the flat with his own keys.
A blood-stained mattress was found lying in one of the rooms. In one of the bathrooms, a body with a face covered with the help of black polythene and cloth was found, the complaint said.
In the meanwhile, complainant Bhupender Singh reached there and identified the deceased as his brother Trilochan.
Delhi Police had registered an FIR on the statement of Bhupender Singh. He stated that his brother Trilochan was a resident of Jammu and a well-known person. His family was residing in Canada.
Bhupender Singh had alleged that accused Harmeet and Khalsa used to visit his brother. His brother was scheduled to leave Canada on September 2, 2021, and he accordingly reached the flat of Khalsa.
He also talked to the wife of the deceased on September 3, 2021, who informed him that Trilochan did not board the flight on September 2, and his flight had been rescheduled for September 3.
Singh further said he also talked to his nephew Karan, who informed him that he had already talked with Khalsa, who informed him that he left Trilochan inside IGI Airport, but forgot his phone, which remained with Khalsa. When he inquired again with Karan, he informed that Khalsa told him Trilochan had been quarantined in Frankfurt, Germany.
The complainant further stated that he made inquiries on his own and came to know that Trilochan did not even reach the immigration at IGI Airport and thus, there was no question of boarding the flight.
He further stated that on September 8, 2021, he was present along with Ranjit Singh
Nalwa, a friend of Trilochan. Nalwa telephoned Khalsa and inquired about Trilochan and Khalsa informed him that he along with Harmeet had killed Trilochan.
Nalwa told him about the said fact and he accordingly reached Delhi. After making inquiries from the police station, he reached the flat.
He alleged that his brother Trilochan had been killed by Khalsa and Harmeet. He also alleged that Sudarshan and Surender Singh Kala had previous enmity with the deceased who also previously extended threats to kill Trilochan and they are behind the killing of Trilochan.
He further stated that there exists a conspiracy hatched by Sudershan and Surender Singh Kala, behind the death of his brother Trilochan, the complaint said.
