Several deficiencies were noted in respect of sanctioned loan including that no list of the member of the society was brought on record, borrowing power of society was not ascertained, the loan was granted under cash credit scheme and it was utilized for purchase of the land in contravention of guide lines. In the course of investigation under PMLA it has surfaced that the petitioner No. 1 misused his official position as Chairman of J&K State cooperative Bank (JKSTCB) & deliberately overlook the procedure involved in the fraudulent sanctioning the amount of Rs. 250 Crores and disbursed to the tune of Rs. 223 Crores and Siphon off the same which was nothing but the proceed of the crime. The accused persons along with some other persons availed the loan of Rs. 250 crores, out of it, amount of Rs. 223 Crores was disbursed in the name of Jhelum Co-operative House Building Society and Siphon off the same as payment towards purchase of the land. The petitioner No. 2 in connivance with the petitioner No.1 have knowingly generated the proceeds of the crime.
Special Judge CBI Srinagar SC Katal after hearing both the sides observed that while granting bail the court has to keep in mind the nature of accusations, the nature of evidence in support thereof, the severity of the punishment which conviction will entail, the character of the accused, circumstances which are pecular to the accused reasonable possibility of securing the presence of the accused at the trial, reasonable apprehension of the witnesses being tampered with the larger interests of the public/State and other similar considerations.
