HC refuses to quash FIR in Insurance Scam

JAMMU, Mar 27: In a significant development, Justice Rajnesh Oswal of the Jammu & Kashmir and Ladakh High Court has dismissed a petition filed by Trinity Reinsurance Brokers Ltd seeking the quashing of an FIR registered by the Central Bureau of Investigation (CBI) in connection with a high-profile scam related to Healthcare Insurance Policy for State Government employees.
The High Court's decision to reject the petition also comes with a directive for the CBI to expedite its investigation into the matter.
The petitioner-company had moved the court seeking the quashing of FIR No.RC1232022A0004 dated 19.04.2022, registered under various sections of the J&K Penal Code and the J&K PC Act. They argued that the Anti-Corruption Bureau (ACB) had already conducted an investigation and found no irregularities in the execution and implementation of the health scheme. Additionally, they contended that the FIR did not disclose any offense committed by them, citing heavy financial losses incurred due to the termination of their contract by the government.
However, the court found merit in the CBI's response, which highlighted allegations of criminal misconduct and conspiracy involving the petitioner-company, RGICL, and government officials. The court emphasized that FIRs serve to set criminal law into motion and are not exhaustive compilations of allegations. Given the ongoing investigation and the complexity of the case, the court deemed it inappropriate to quash the FIR at this stage.
Furthermore, the court rejected arguments regarding delay in registering the FIR and jurisdictional issues raised by the petitioner's counsel, emphasizing previous court judgments on similar matters.
While denying the petition to quash the FIR, Justice Rajnesh Oswal directed the CBI to expedite its investigation and instructed the petitioner-company to cooperate fully in the process.
This ruling underscores the court's commitment to impartial and thorough investigation of alleged criminal activities, ensuring transparency and accountability in governance.
