14 years Rigorous Imprisonment, a fine of Rs 100,000/- awarded in rape case

UDHAMPUR, Apr 25: Addl. Session Judge Udhampur today awarded 14 years rigorous imprisonment to accused Sanjay Kumar S/o Amar Nath R/o Jib, Udhampur who was facing trial for the commission of offences U/S 376/342 RPC for the last seven years.
Brief fact of the case, accused committed rape upon the victim of tender age of 8 yrs. and the accused was 30 yrs. married person. As per police case accused was living in the neighbourhood of the victim. Accused while taking the benefit of the tender age of the prosecutrix wrongfully took her inside Kacha room of his house and restrained her in that room and committed rape upon her.
The Honble court in the instant case after hearing ld. Counsel for the accused namely Gulshan Singh Shan and Shri Hemanshu Parkash Addl. Public Prosecutor for state and counsel for the accused after extremely carefully accepting the sole testimony of the prosecutrix has ordered that accused Sanjay Kumar for the commission of offence U/s 376 RPC shall undergo rigorous imprisonment for a period of 14 years and a fine of Rs. 100000/- and for offence U/S 342 RPC accused shall undergo imprisonment for the period of one year.
Both the sentences shall run concurrently. The fine amount shall be paid to the victim as compensation.
In default of payment of fine the convict shall further undergo imprisonment for six months.
