Court reject bail of Moulvi for solemnizing marriage of minor

Jammu, June 10: Principal Sessions Judge Bhaderwah Amarjeet Singh Langeh today rejected the bail application of Moulvi namely Mohd Sharief Lone allegedly involved in solemnizing marriage of minor. complainant in the case who is mother of victim, lodged written complaint with Respondent-Police Station disclosing therein that she is a widow and has 04 minor daughters; that her eldest daughter, the victim in this case – went to purchase medicines at Doda on 24/25th of April, 2024 and principle accused in the case namely Waseem Ahmed S/O Riyaz Ahmed R/O Dhudote, Tehsil and District Doda lured and enticed her and entered into Nikah with her; that said Waseem Ahmed is a married person with 5/6 children; that said accused keeps on roaming freely in the area enticing minor girls by showing them green pastures and does illegal activities with them; that he plays with the lives of innocent minor girls; that petitioner herein who is a Moulvi took hefty amount from principle accused aforesaid and acted as Nikah-Khawan and facilitated Nikah-nama of her minor daughter (victim) with principle accused Waseem Amed in absence of her guardian and – knowing that the victim is minor and by hurling threats to her etc. etc. Complainant accordingly sought legal action to be taken against the two accused.
Based on this complaint initially FIR No.100/2024 for offences under sections 363/367/365/366-A/109 of IPC and Sections 9/10/11 of Prohibition of Child Marriage Act was registered and investigation started. During investigation, it came to fore that principle accused also committed rape on minor victim and petitioner herein coerced minor victim to execute Nikah-nama with principle accused and subsequently, he also destroyed the Nikah-nama register, therefore offences under sections 376/109/201 of IPC and Section 4 and 11 of POCSO Act were also added.
Statement of victim under sedition 164 of Cr.P.C was also recorded during investigation wherein victim alleges that principle accused drove her forcibly, took her to his residence wherein a Moulvi (petitioner) forced her to sign a document; that Moulvi also threatened her that if she refuses to sign the document, she then would be done away with and that accused Waseem did wrong to her etc. etc.
Principal Sessions Judge Bhaderwah Amarjeet Singh Langeh after hearing both the sides while dismissing the bail application observed that there is prima facie evidence regarding involvement of petitioner in the abetment/ intentional aid in offences alleged against principle accused as aforesaid. All these offences are heinous and the alleged victim is a minor. Release of petitioner on bail at this stage therefore shall not only hamper the ongoing investigation qua antecedents of petitioner and principle accused but it will also end up in diminishing the faith of public at large in the process and execution of law in the circumstances like those in the case in hand
