Court awards 7-yrs imprisonment in minor’s rape case

Jammu, Feb 12: Principal Sessions Judge Ganderbal Abdul Nasir today awarded seven years imprisonment and fine Rs 25000 to Amir Ashraf Zargar s/o Mohammad Ashraf Zargar, R/o Waripora Safapora, Ganderbal who was facing trial in rape with minor for the last 9 years.
According to the police case that on 06-07-2016 complainant lodged a written complaint in the police station concerned alleging therein that his minor sister aged about 14 years (name with held, and shall be referred as prosecutrix herein after) had gone to picnic at Dumping Park Kangan and did not return her home till evening. The complainant and his other family members started her search, however could not trace her. But during search they came to known that accused Amir Ashraf Zargar son of Mohammad Ashraf Zargar resident of Waripora Safapora had kidnapped prosecutrix with an intention to commit rape upon her. On this report FIR No.67/2016 was registered in the police station Kangan for offence under section 363 RPC and investigation was started, site plan was prepared, statements of witnesses were recorded under section 161 Cr.PC and search of prosecutrix was started. During search neither accused nor prosecutrix were traced however the family members of accused as well as some respectable of the village were asked to produce accused and prosecutrix before the police. Accordingly accused and prosecutrix were produced before the police station on 23-08-¬2016. Accused was arrested in the case and medical checkup of the prosecutrix was got conducted through SDH Kangan. Medical report of the prosecutrix was obtained from which the commission of rape was made out, therefore accused was found involved for the commission of offences under sections 363,376 RPC hence this challan.
Principal Sessions Judge Ganderbal Abdul Nasir after hearing both the sides observed that in the present facts and circumstances of this case, the accused is sentenced to simple imprisonment for a description for a term up to 7 years for offence u/s 363 RPC and a fine of Rs. 10,000/- Accused is also sentenced for 7 years for offence u/s 376 RPC and fine of Rs 25,000. Both the sentences shall run concurrently. (JNF)
