Court awards 1 yr imprisonment, fine to Matador driver for causing death to a person | | | Early Times Report JAMMU, May 23: Chief Judicial Magistrate Jammu Preet Simran Kour Grover awarded one year imprisonment and fine Rs 10000/- to Gourab Sharma a Matador driver after 15 years trial. Brief facts of the prosecution case are that on 03.10.2010, one matador bearing no. JK02U-1306 which was being driven by driver namely Gourab Sharma S/o Puran Chand R/o House No. 237, Lane No. 19, Jawahar Nagar, New Plot, Jammu, in a rash and negligent manner that too at a high speed while coming from Janipur and heading towards Parade. At around 11.30 am, when the said driver driving at high speed reached near Ranbir Press Government at Amphalla, then he hit one motorcycle bearing registration no. JK12-1869 which was coming from opposite side. Due to the said hit, the pillion rider of motorcycle namely Kashish Vaid S/o Kamal Kishore R/o Surankote sustained injuries whereas motorcyclist was unhurt. The persons present at the spot took injured to hospital GMC, Jammu. The driver of the matador left the matador on the spot and fled away. Both the vehicles are lying at the spot. CJM Jammu Preet Simran Kour Grover after hearing APP Vikram Parihar for the UT whereas Adv Anil Biloria for the accused, observed that "Bearing in mind the galloping trend in road accidents in India and the devastating consequences visiting the victims and their families, criminal courts cannot treat the nature of the offence under section 304-A RPC as attracting the benevolent provisions of Section 4 of the Probation of Offenders Act". Therefore, accused is hereby sentenced to undergo simple imprisonment for one month with fine of Rs. 1000/- for commission of offence under section 279 RPC as well as simple imprisonment for one year along with payment of a fine of Rs. 10,000/- for commission of offence under section 304-A RPC whereby a total fine of Rs. 11,000/. —JNF |
