Court awards 7 years imprisonment in rape case after 21 years of Trial and investigation

JAMMU, July 29: Principal Sessions Judge Udhampur Virender Singh Bhou while deciding 21 years old case, convicted a rape accused namely Makhan singh son of Romal singh and sentenced him to 7 years imprisonment for raping a girl in Majalta area of District Udhampur in 2004.
According to prosecution after the incident a case under FIR Number 20/2004 under Sections 366/ 376/342/34 RPC was registered at Police Station majalta against two accused out of which one of the accused Makhan Singh was arrested by Majlta police while another was declared absconding under section 512 CRPC and challan of the case was produced before the Court.
Principal Sessions Judge Udhampur Virender Singh Bhou after hearing Public Prosecutor Himanshu Gupta with APP Vinay observed that accused made has made confessional statement voluntarily without pressure, undue influence, coercion or incitement. In view of the confessional statement made by the accused is convicted and sentenced to undergo simple imprisonment for 7 years for commission of offence under section 376 RPC and to undergo simple imprisonment for 3 years for commission of offence under section 366 RPC and to pay fine of Rs. 1000/-. In default of payment of fine accused shall further undergo simple imprisonment of one month and for commission of offence under section 342 RPC accused is sentenced to undergo simple imprisonment for one month. The substantive sentences awarded shall run concurrently. The period of custody undergone by the accused i.e. 4 years 10 months and 26 days shall be set off against the sentences inflicted upon the accused and after undergoing and completion of remainder of sentences he shall be set free by the Superintendent District Jail Udhampur if not required in any other case. —JNF
