NIA Court frames charges against two Hizbul OGWs

Jammu, July 29: Special Judge NIA Sandeep Gandotra framed charges against Waheed Ul Zahoor and Mubasshir Maqool Mir an Over Ground Wokers of Banned terrorist organizations Hizbul-Mujahideen.
The brief facts of the case are that on 30-06-2024, Inspector Iftikhar Hussain, SHO Police Station Bomai, Sopore along with Police Party, 22 RR and CRPF 179 Battalion had established a naka at Machipora, Rashidabad for checking of vehicles. During checking of vehicles, one vehicle Maruti Swift car (white colour) bearing registration number JK01AK-4452 which was on its way from Bomai to Machipora was signaled to stop, but the driver of the said vehicle tried to flee away from the spot. The Police party tactfully stopped the car, apprehended the driver of the said vehicle. On the basis of suspicious act of the driver of the car, his personal search was conducted and during his personal search, one Chinese Pistol along with Pistol Magazine, ten live rounds of pistol, one Chinese hand grenade and two mobile phones (Make-One plus Colour-Black and Make-Motorola and Colour Green) were recovered from his personal search.During preliminary enquiry, the said driver of the vehicle revealed his identity as Waheed Ul Zahoor S/o Zahoor-Ul-Rahim R/o Hadipora, Rafiabad A/P Mustafabad, HMT, Srinagar. Search of the vehicle was also conducted and during the search of the car some more arms, ammunition, explosive and other incriminating material such as chemicals and powder was recovered indicating the driver's links as an OGW associated with one of the banned terrorist organizations Hizbul-Mujahideen (HM). Accordingly, a case FIR No. 37/2024 was registered in Police Station Bomai under sections 16, 18, 23 & 39 of UA (P) Act,1967. Section 2 & 4 of the Explosive Substances Act, 1908 and Section 7 & 25 of the Arms Act, 1959. (5) It was established during the course of investigation that both these accused were in close contacts with one of their handlers a Kashmiri terrorist based and operating from Pakistan namely, Tajamul Islam Malik through social media App Facebook, Signal, WhatsApp and Element. It was established that Mubashir Maqbool Mir (A-3) transferred some funds in the bank accounts of Waheed-Ul-Zahoor (A-1) on the directions of Tajamul-Islam-Malik for funding to the OGWs of HM for enhancing terrorist activities in Kashmir valley.
Special Judge NIA Sandeep Gandotra after hearing both the sides observed that if the broad probabilities of the case and the total effect of the evidence collected by the CIO and the documents produced before the court are to be taken into consideration, prima-facie there is sufficient material against the accused A1 & A3 to charge them for the commission of offences in this case. The evidence collected & relied upon by the CIO is in accordance with law and corroborative material is also available on the record. Accordingly, accused Waheed Ul Zahoor (A1) is charged for the commission of offences under Sections 18 of UA (P) Act, Sections 7 & 25 of Arms Act and Section 2 & 4 of Explosive Substances Act. Accused Mubasshir Maqool Mir (A3) is charged for the commission of offence under Section 18 of UA (P) Act 1967. (JNF)
