Early Times Report KATHUA, Sept 17: In a landmark decision under the Bharatiya Nyaya Sanhita (BNS), J&K Police kathua Police P/S Bani secured the conviction of four individuals for public intoxication and disorderly conduct.The Hon'ble Court delivered its verdict on 16-09-2025, marking a progressive step toward reformative justice. The convicted individuals are:- Roshan lal S/o Girdhari lal R/ sarpatti ,Teh -Bani Kamal kishore S/o Hans raj R/o surjan ,Bani Pankal kumar S/o Ampi lal R/o Backon ,Bani Shoket Ali S/o Mukhtyar ahmed R/o Backon,Bani The Hon'ble Court sentenced all four accused to 01day of community service, during which they will be required to mark their attendance at the court and perform community cleaning work. The incident took place on 13 & 14-Sep-2025 within the jurisdiction of Police Station Bani, where the accused were found in an intoxicated state and causing a public disturbance. They were arrested on the spot, medically examined, and subsequently produced before the Learned Judicial Magistrate First Class (JMIC), Bani. In a noteworthy departure from conventional punitive measures, the Hon'ble Court, exercising its discretion under Section 355 of the Bharatiya Nyaya Sanhita, opted for a reformative sentence. The accused have been directed to carry out community service for 01 day, i.e 16-09-2025, at the Honble court of JMIC Bani Kathua This decision reflects the essence of the newly implemented criminal laws, which emphasize rehabilitation and community engagement over imprisonment especially in cases involving minor offences. The proactive action taken by Kathua Police aligns with this constructive and reform oriented approach to handling public misdemeanours, setting a precedent for similar cases in the future. |
