Early Times Report JAMMU, Sept 26: The High Court of Jammu & Kashmir and Ladakh on Thursday disposed of a five-year-old public interest litigation (PIL) that sought modernization of cremation grounds across Jammu, including the Jogi Gate cremation ground. The petition had been filed in 2020 by Sumit Nayyar, a practicing lawyer, who urged the court to direct authorities to improve infrastructure and facilities at cremation sites. Over the years, the court monitored the matter closely, directing the government to submit status reports and progress affidavits. A Division Bench comprising Chief Justice Arun Palli and Justice Rajnesh Oswal observed that the PIL had "substantially served its purpose," as authorities had already executed multiple works in line with the court's orders. During the hearing, Nayyar fairly conceded that, in light of the numerous affidavits and status reports filed by authorities, nothing substantive remained in the petition. He requested the court to dispose of the matter, keeping liberty to revive the petition in case of any fresh cause of action. The court accepted the submission and formally closed the proceedings, while granting liberty to the petitioner to either seek restoration of the case or file a fresh petition in the future, should new issues arise. —(JNF) |
