Early Times Report JAMMU, Feb 25: With reference to the news item titled "HC Flags Administrative Lapses as Detention Orders Missing in Multiple Habeas Corpus Cases" published/issued by JNF, it is hereby clarified that there was no lapse on the part of the High Court's administrative/official website or its uploading mechanism. It is further clarified that the lapse, as noticed in the proceedings, was on the part of the Government/concerned detaining/sponsoring authorities in these habeas corpus petitions, inasmuch as complete detention record/documents were not properly produced/placed on the judicial record before the Court, thereby hampering effective judicial scrutiny. Para 14 (as reflected in the record of HCP No. 131/2025) also highlights non-supply of complete material to the detenue: the Court noted that though the covering letter dated 09.06.2025 indicated enclosures including the detention order (3 leaves), grounds of detention (6 leaves) and dossier (89 leaves), the receipt/execution report showed that only 53 leaves were furnished and the dossier was not supplied at all, making the plea of incomplete supply well founded. Any impression suggesting that the documents were missing due to the High Court website/administrative system is inadvertent and is regretted. JNF |
