Early Times Report JAMMU, Mar 26: Welcoming the recent judgment of the Supreme Court of India, prominent SC community social activist and former Vice Chairman, Balbir Ram Rattan, today said that the ruling, delivered in the context of clarifying whether individuals can continue to claim Scheduled Caste (SC) status after converting to other religions, will play a crucial role in preventing misuse and dilution of reservation benefits. He said that the Hon'ble Court has clearly held that Scheduled Caste status is confined to individuals professing Hinduism, Sikhism, or Buddhism, and that conversion to religions such as Christianity or Islam leads to the loss of SC status and related benefits. By reaffirming the provisions of the Constitution (Scheduled Castes) Order, 1950, the Court has brought much-needed clarity on a long-debated issue. "The judgment makes it clear that reservation benefits cannot be claimed outside the constitutional framework. This clarity will ensure that only those who are genuinely entitled receive these benefits," he stated. Balbir Ram Rattan emphasized that reservation is a sensitive and important tool for social justice, aimed at uplifting historically disadvantaged sections within a specific social context. The issue had created confusion in certain cases where individuals continued to claim SC benefits even after changing their religion. This ruling removes that ambiguity and strengthens the integrity of the system. Balbir further noted that the decision will help curb instances of wrongful claims. "Continuing to avail benefits without meeting the prescribed criteria not only violates the law but also deprives deserving candidates of their rightful opportunities in education, employment, and welfare schemes and the Supreme Court's ruling effectively closes this loophole," he added. Highlighting the administrative benefits, he said that the judgment will assist government departments, educational institutions, and recruiting agencies in implementing reservation policies more efficiently. With clear guidelines in place, there will be fewer disputes, faster decisions, and better governance. Balbir Ram Rattan said that the ruling strengthens the credibility of India's reservation system. It is a positive and progressive judgment that ensures fairness, protects the interests of the truly deserving, and reinforces public confidence in our constitutional framework. |
