| NIA Court rejects bail in Jammu IED conspiracy case | | | Early Times Report JAMMU, July 1: The Special Judge NIA Cases, Jammu, Prem Sagar, has rejected the bail application of Nadeem Ul Haq of Banihal, Ramban, who is facing trial in the 2021 Jammu IED conspiracy case investigated by the National Investigation Agency. The accused had sought bail on the ground that he has been in custody since June 27, 2021, and that the trial was moving slowly. His counsel argued that only a limited number of prosecution witnesses had been examined so far and claimed that there was no likelihood of conviction. The NIA strongly opposed the plea, alleging that the accused was intercepted while carrying an IED with the intention to target innocent people and security forces. The agency submitted that the accused had come in contact with co-accused persons and Pakistan-based handlers associated with TRF/Lashkar-e-Taiba through social media and WhatsApp groups. According to the NIA, the accused allegedly travelled to Jammu on instructions from Pakistan-based handlers for execution of an IED blast and was arrested before the alleged plan could be carried out. The prosecution also argued that there was a bar under Section 43-D(5) of the UAPA where accusations are found prima facie true. After hearing both sides, the court observed that the trial was already underway and that material on record indicated the involvement of the applicant in furtherance of the alleged conspiracy. The court held that releasing the accused at this stage could lead to influencing key witnesses and hamper the process of justice. Keeping in view the nature and gravity of the offences and the larger interest of the State/UT, the court rejected the bail application. (JNF) |
