HC stays construction around water bodies, Khads | | | JAMMU, July 10: High Court today stayed construction in the areas of water body or abetting the water body besides sale of land concerning the bed of the river and the land recorded in the revenue records as Khad. This order was passed by the High Court in a Public Interest Litigation filed by Balbir Singh, Secretary of a registered Society called Kailash Assisto Oceanic Society (an NGO) against inaction on the part of the state in implementing Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010, with the object of consolidating the law relating to measurement, construction, control and management of works with respect to water storage, irrigation and water supply. In the PIL it has been said that the banks of River Tawi are being illegally occupied by unscrupulous elements, one of the examples being occupation of Khad by constructing a colony called Gujjar Nagar, just behind the Jogi Gate cremation ground, where Hindus cremate their dead after "Ashnan" by the water of River Tawi, which is known as "Surya Putri" (daughter of Sun) in Poranik Books. As the result of illegal constructions from Sidhra Bridge to Nikki Tawi Bridge, the waste water from these colonies is pouring in and polluting the pious water of River Tawi and the people of the city are compelled to bathe their dead with the polluted water of the river, which is hurting the sentiments of a particular community of Jammu. This is also required to be stopped. Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Tashi Rabstan today after hearing Adv Abhinav Sharma appearing for the PIL issued notice to Chief Secretary and ors and in the meanwhile Division Bench stayed the further construction in the areas of water body or abetting the water body and also stayed the sale of land concerning the bed of the river and the land recorded in the revenue records as Khad.
