SIC issues notice to SMC

Srinagar, Dec 26: The State Information Commission (SIC) has issued notice to Srinagar Municipal Corporation (SMC) directing the Enforcement Officer to provide information about alleged illegal constructions to an information seeker under RTI Act. The information was earlier denied by the officer which prompted the information seeker to file an appeal before SIC here.
Details available with Early Times reveals that one Abdul Rasheed Misgar a resident of Shamaswari Srinagar filed an appeal before State Information Commission (SIC) Srinagar, wherein he had asked the Chief Enforcement Officer to provide action taken report to him. But till the date of filing of second appeal, no action taken report was provided to him. The appellant prayed before SIC that requisite information be provided to him under the provisions of State RTI Act.
Details further reveal that the appellant had filed an application under J&K RTI Act, 2009 before PIO/Secretary SMC Srinagar on 12.05.2015 seeking action taken report on his application dated 06.04.2015 and action taken on report of Ward Officer dated 22.04.2015 for alleged illegal construction. Thereafter, the applicant filed First Appeal before the FAA/Commissioner SMC Srinagar on 06.07.2015 submitting that in response to his RTI application he received a communication on 30.05.2015 from PIO SMC Srinagar dated 18.05.2015, wherein he was directed to appear before the PIO / Secretary SMC on 28.05.2015.
In compliance to the directions of the Information Commission passed on 04.12.2015, Hilal Ahmad Deewani PIO/Secretary SMC Srinagar enclosed reply of Chief Enforcement Office SMC Srinagar dated 12.12.2015 regarding action taken on the complaint of the appellant Abdul. Rashid Misgar received under No.2027 dated 06.04.2015.
In its order, SIC ruled,"The Enforcement Officer East SMC Srinagar, who has signed this report, has not indicated his name as is required under rules. The APIO SMC submitted that his name is Mohammad Ashraf Warsi. Although this information has reportedly been send through registered post, the appellant submitted that he has not received it. Accordingly, PIO is directed to provide another set of attested information to the appellant. Further, PIO SMC Srinagar is directed to instruct all supporting staff/officers of SMC to indicate their name and designation on all documents which are filed before the Commission as is required as per standing norms/rules of the government. With the above directions, the appeal filed before the Commission is disposed of with the above directions"
