HC quashes ReT teacher's appointment

Jammu, Oct 7 : High court judge Alok Aradhe has quashed the appointment of a Rehbar-e-Taleem (ReT) teacher who had also been regularised as a general line teacher. Banarsi Lal, son of Isher Dass of Kotli Manotrian, Reasi, was appointed as ReT 3rd teacher in government primary school, Julla, in 2003 and regularized as general line teacher vide order No ZEP/Rsi/2470-2524 on April 13, 2010. The court directive came in a petition filed by one Yog Raj, son of Tara Mani of Karua, Reasi. After hearing the two sides, Justice Aradhe quashed the appointment of Banarsi Lal and directed the education department to consider the petitioner's candidature for appointment against the said post as per qualification prescribed in the December 27, 2002 advertisement. He directed that this exercise be concluded by the competent authority within two months from the date of receipt of the certified copy of this order. "From perusal of record, it is evident that the process of selection was set in motion on December 27, 2002 through an advertisement, according to which the qualification was higher secondary school examination, but after the process of selection commenced, the government issued an order on August 22, 2003 by which it was provided that minimum qualification for appointment to the post of 3rd teacher shall be graduation," he observed. Justice Aradhe observed that the August 22, 2003 order was stayed by a bench of this court by an interim order on October 3, 2003 passed in SWP No 1864/ 2003 and the respondents were directed to consider the candidature of the petitioner. However, the respondents, instead of considering his petitioner, appointed Banarsi against the post in question. "Once the selection process commences, the criteria for selection cannot be changed mid way," he said, while rejecting the AAG's prayer for production of record on the ground that the writ petition was pending since 2003," he said. With these observations and directions, Justice Aradhe quashed the appointment of Banarsi and directed the authorities to consider the petitioner's appointment.(JNF)
