R&B Deptt makes mockery of Guv admin with impunity

Jammu, Aug 12: Top government sources reveal that Designs, Inspections and Quality Control department of the state- which comes under the purview of the R&B department has been failing norms and laid down procedure with impunity and with no fear of the consequences for throwing rules to the wind.
The posts of three Deputy Research Officers in its Srinagar wing have been held up within the department illegally by the junior level engineers. Further, a JE has been working in violation of the rules in the department's Road Research Laboratory.
The post of the JE is nowhere existent in the laboratory but the JE in question has managed to grab the post and discharge the duties there. No one has touched him so far.
Also, the posts of the Research Officer is held illegally by a Junior level engineer who is otherwise an Incharge AEE in the R&B Department. Besides that the three posts of the Deputy Research Officers that have to be directly filled by the Public Service Commission are occupied by the Junior Level Engineers in violation of the rules. However, the R&B seems to have been least moved by such a violation of the rules under its noose, preferring to remain ostrich with head stuck in the sand.
Details coming to fore reveal that the official who has occupied the post of the Research Officer, Srinagar was removed by the High Court of Jammu and Kashmir from his post via its landmark judgment on June 20, 2015. However, due to his sycophant approach and a relative at a senior post in Civil Secretariat, rules were bent for the official and he continued to remain on the said post even in violation of the rules.
Bypassing the Standard Operating Procedure, the official has made the Department his own enterprise and has been able to make the infiltration of his own men possible via the back door. "There are clear cut directions from the Supreme Court that the post which has to be filled by the Public Service Commission shall in no way be allotted to any official on Incharge bases. However, in clear violation of the rules, there are three own men of the officer whom the officer managed to post as Deputy Research Officers. The posts are to be filled by the Public Service Commission. However, the guidelines have been kept aside and rules thrown to wind," sources in department's Jammu office divulged.
The post which the official is presently holding was quashed by the High Court in its judgement on June 20, 2015, stating that having found that the experience said to have been gained by the official prior to obtaining Master's Degree could not have official was not eligible for selection and appointment as Research Officer pursuant to vacancy Notification No. 9-PSC (supra) so his selection cannot sustain and it is noticed that official has questioned the eligibility of the petitioner. However, it is also noticed on reading the counter affidavit and the supplementary affidavit filed by official that petitioner's qualification has been challenged with the purpose to oust him from maintaining the writ petition on the ground that he was not eligible for the post. Decision of the PSC in holding the petitioner eligible and calling him for interview, though at a later stage, has not been challenged nor has its quashing been sought. No case for disputing the petitioner's eligibility, therefore, has been made out.
With these observations Justice Janak Raj Kotwal allowed the petitioner with the direction that selection of official for the post in terms of Select List dated 19.05.2010 issued pursuant to Vacancy Notification No. 9-PSC of 2009 dated 17.03.2009 is quashed and also directed PSC to declare the petitioner as selected candidate.
