Early Times Report
Jammu, Feb 27: A complaint has been filed against former Chief Minister and President of People's Democratic Party (PDP) Mehbooba Mufti for allegedly making seditious statements.
A Jammu-based eminent social activist Sukesh C.Khajuria filed a complaint with District Magistrate, Jammu seeking legal action against her for her seditious statement on National Flag which represents the national honour and her threat of 1947 like violence erupting in J&K if Article 35A was repealed.
Khajuria has sought initiation of action under section 196 Cr PC for Commission of offence under Section 124-A RPC (sedition) and other provisions of Law.
Giving reference of the media reports, Khajuria stated that Mehbooba Mufti while addressing a press conference at her Gupkar road residence in Srinagar on 25th February, 2019, indulged in commission of offence under section 124-A RPC. She said "I am in contact with NC President Omar Abdullah. We should have a strategy so that there is no attack on Article 35A and if there is an attack, then I do not know which flag other than the Tricolour, would the people of Kashmir bear on hand & if they do so then do not tell us that we had not warned you (centre). Do not push the people of J&K to the wall".
At this press conference, Mehbooba Mufti warned that any tampering with the special status would "undermine and nullify" state's accession with the Union of India and worsen the situation in the State to an extent never seen before. She said that "it is the collective responsibility of both mainstream and separatist groups to be united to foil every attempt aimed at harming the special status of the state. My party is ready to go to any extent; we will not hesitate to hit streets in case Article 35A attacked tinkered with".
In his complaint, Khajuria stated that the seditious statement made by Mehbooba Mufti is an incitement to violence" or "Public disorder" and falls within ambit of Section 124-A RPC which falls under Chapter VI of the RPC. Therefore, Section 196 of Cr. PC is attracted.
Khajuria has also communicated the issue to the President of India Ram Nath Kovind, Prime Minister of India Narendra Modi.
