Police should ensure permanent end to illegal, unauthorized vending place: DB | | | Early Times Report
JAMMU, Mar 20: In a Public Interest Litigation regarding ensure reduction of the traffic congestion in Srinagar a Division Bench of High Court at Srinagar Wing Comprising Chief Justice Gita Mittal and Justice Rajesh Bindal observed that when vendors are removed for relocating from one spot, the Police has to intervene to make sure that the illegal and unauthorized vending place wherefrom they have been relocated, is permanently stopped. It would appear that this is not happening. When the PIL came-up for hearing, DB Observed that status reports stand filed by Deputy Commissioner, Srinagar, Vice-Chairman, SDA, SSP, Srinagar, & SSP, Traffic City, Srinagar and it is submitted by counsel appearing for Srinagar Municipal Corporation that his status report is ready and he will file the same during the course of the day. Let the same be so filed within one day. Advocate Ateeb Kanth, amicus curiae drawn the attention of the court to the order dated 08.06.2017, whereby this Court had appointed the Committee comprising Divisional Commissioner, (Kashmir) (Chairman), Transport Commissioner (J&K) (Member). MOHAMMAD ALTAF NIMA, Vice Chancellor, SDA (Member) and Commissioner, SMC (Member). The DB observed it would appear that over the passage of time, the meeting of all the Committee members was essential to have a coordinated actions with regard to reduction of traffic congestion in the Srinagar city. Even before us, the submission made by counsel would suggest that inter departmental cooperation is essential so as to ensure reduction of the traffic congestion in Srinagar. Say, for instance, when vendors are removed for relocating from one spot, the Police has to intervene to make sure that the illegal and unauthorized vending place wherefrom they have been relocated, is permanently stopped. It would appear that this is not happening. DB directed Chairperson of Committee to ensure that the meetings as directed by this Court on 08.06.2017 are regularly held on a monthly basis. It shall be open for the Divisional Commissioner, Kashmir (Chairperson) to schedule a regular date and time for the meeting which shall be attended by all the above-said Committee members in order to examine the steps taken and directed that t the first meeting of the Committee be held on 8th April 2019 at 3:00 pm also directed Committee may examine the steps taken on the issues placed before this Court and noted in our order dated 12.09.2018. The outcome of the meeting shall be placed by Mr. Dar, Sr. AAG before us on the next date of hearing. |
