DC Poonch cancels illegal mutation of Forest land in favour of Ex-MLC

District Collector (Deputy Commissioner) Poonch cancelled illegal mutation of Forest land in favour of Ex- Member Legislative Council (MLC).
According to sources, in a rare of the rarest cases the District Collector Poonch has declared mutation No.297 under 394-C void ab-initio which was attested illegally in favour of Ex MLC resident of Nar, Mendhar.
"The Ex-MLC encroached upon the Forest land measuring about more than 10 Kannal. Divisional Forest Officer Poonch, Mohan Choudhary was perusing the case vigorously with the plea that Khasra No. 364 is recorded as Ghair Mumkin Jungle in records of right (1961-62) and the mutation No. 297 is against the statuary provision are not recognized by law", sources said.
They further alleged that the Forest land is governed under Forest Act & Forest Conservation Act wherein no Official of Government shall have the power to issue any order or notification for diverting the forest land for non-forestry purposes.
"The District Collector Poonch called revenue record & report dated 11-12-2019 from field staff and it was found that as per revenue record Khasra No. 764 village Nar recorded as Ghair Mumkin Jungle which is Forest land", they said, and added, "After going through the various Circulars & Judgments of the courts issued from time to time, District Collector Poonch declared mutation No. 297 under 394-C as void ab-intio, therefore there is no provision to file an appeal against said illegal mutation on exempted land."
He further directed Thinildar Mendhar to rectify the revenue record and make requisite in favour of Forest Department. Forest & Revenue departments shall proceed for physical eviction encroached Forest land.
