DB directs Trial Courts to ensure compliance of maintenance allowance’s payment

JAMMU, May 26 : A Division Bench (DB) of J&K High Court comprising Chief Justice Gita Mittal and Justice Rajnesh Oswal while hearing a Suo-Moto Public Interest Litigation on domestic violence, directed all Trial Courts to evolve appropriate mechanisms to ensure that the orders of payment of maintenance are complied with despite lockdown.
It shall be open for the Trial Courts to use any mode of communication including Mobile Phones; emails; landline phones and e-modes of payment to ensure that the dependents in whose favour maintenance orders have been passed, actually receive the maintenance.
When the PIL came up for hearing, the ASGI sought time to submit the report regarding the mechanism in Ladakh with regard to meet the needs of victims of domestic violence, elderly abuse, child violence and violence against trans-genders.
DB directed to file the same before the next date of hearing.
DB further observed that the Member Secretary of the Jammu and Kashmir State Legal Services Authority has also not filed report in terms of para-9 of our order dated 13th May 2020 whereby Division Bench directed e Jammu and Kashmir State Legal Services Authority should continue to assist all needy people in terms of the several programs being pursued by it. DB directed such report on the issue under consideration be placed before us before the next date of hearing. JNF
