Court rejects bail of job racket accused
2/6/2021 11:20:28 PM
EARLY TIMES REPORT
JAMMU, Feb 6: Special Mobile Magistrate Passanger Tax Court Jammu Sandeep Gandotra today rejected the bail application of one Manzoor Hussain Qadri who was running a job racket scam and duped the innocent youth of J&K on the pretext of arranging government jobs.
According to the police case that in FIR No.46/2020 under section 420, 465, 467, 468, 471, 120-B IPC it is stated that a written complaint was lodged by Raman Kumar Kattru S/o Dev Raj A/p Guru Nanak B.Ed college Lower Jallo Chak Tehsil Bari Brahmana Distt Samba and others wherein they have alleged inter alia that the suspects namely Fayaz Ahmed Dar of Chanpora Pattan, Mushtaq Ahmed Ganai of Bai Mulla Kulgam and Manzoor Hussain Qadri of Sopore have cheated them on the pretext of providing job and issuing fake appointment orders in favour of various candidates by taking money. After the preliminary enquiry it was found that accused persons Fiaz Ahmed Dar, Mushtaq Ahmed Ganai and Manzoor Ahmed Qadri (applicant herein) have created a fake recruitment racket and are looting innocent unemployed youth in the name of providing government jobs in different departments.
Special Mobile Magistrate Passanger Tax Court Jammu Sandeep Gandotra after hearing both the sides observed that the court in such case cannot pass a blanket order of bail because the court cannot go beyond the statutory command of law, more so when the faith of general public and unemployed youth of the country is involved.
Keeping in view the nature of allegations, character of evidence collected by IOs, stage of investigation, the fact that co-accused persons are still absconding, the fact that huge amount of money Rs 33 lakh has not been recovered and involvement of public interest, this court is of the humble opinion that discretion of bail in favour of accused cannot be exercised at this stage. The bail plea of accused is rejected and this bail application is accordingly dismissed.
