| Court awards life-imprisonment to murder accused | | | EARLY TIMES REPORT JAMMU, Jan 30 (JNF) : Principal Sessions Judge Samba Kartar Singh Wednesday awarded life-imprisonment to Romesh Singh who had murdered his friend Omkar Singh. According to the police on February 3, 2009, information was received from the reliable sources that Ramesh Singh had inflicted grievous injuries on the head of Omkar Singh and he died on the spot. FIR No 17/2009 for the commission of offence falling under section 302 RPC was registered with police station Samba and during the investigation it was found that on the day of occurrence the deceased and the accused had boarded a matador (JK02R/4629) from Samba and got down at Sumb. They went to the shop of the brother of the deceased from where accused purchased 50 kg cattle feed and 50 kg flour and asked the shopkeeper to send the same on mules to his home. Thereafter the accused and the deceased started walking on foot towards their home and when they reached at Sumb Nallah Khad at 9.30 PM, the accused on account of previous enmity inflicted injuries on the head and face of the deceased with a stone, due to which he died on the spot. After investigation the final report was submitted in the court. The court after hearing both the sides observed that Section 302 RPC mandates that whoever commits murder shall be punished with death or imprisonment for life and shall also be liable to fine. "The only consideration in this case is whether the accused should be awarded capital punishment or imprisonment for life. Now it is well settled that except in gravest cases of extreme culpability. The life imprisonment is a rule and death penalty is an exception and should be awarded in the rarest of rare cases," the court observed. |
