| 11 yrs RI to rape accused | | | ET Plus Report
Jammu, Mar 18 (JNF) : Additional Sessions Judge Udhampur MK Sharma today awarded 11 yrs rigorous imprisonment to Kumar Singh s/o Badri Nath R/O Kalsote Tehsil & Dist. Udhampur who is facing trial for the last more than six years in case of raped with minor. According to the police case , on July 11, 2006 victim had gone to attend the call of nature in the forest at village Kalsote Tehsil Udhampur from where she was forcibly kidnapped by the accused persons and under the threat of death she was taken to forest. The accused Kumar Singh committed rape upon her that night. Thereafter the accused person took her to different places and she was ultimately recovered from the possession of the accused. Police filed this charge sheet against the accused Kumar Singh for the commission of offences u/s 376/343/363/34 RPC and against the accused Chottu Ram for the commission of offences u/s 363/343/34 RPC. Additional Sessions Judge Udhampur MK Sharma observed that accused has committed offences punishable u/s 376/363/343 RPC. So far as accused Chottu Ram is concerned, there is no allegation of rape against him in the police report. He was charged for the commission of kidnapping and wrongful confinement. The accused Chottu Ram is therefore acquitted of offence u/s 363 RPC but convicted for the commission of offence u/s 343 RPC only. In view of the facts and circumstances of the case, the accused Kumar Singh is sentenced to rigorous imprisonment for 8 years and fine of Rs. 5000/- for commission of offence under section 376 RPC, rigorous imprisonment for three years and fine of Rs. 2000/- for the commission of offence under section 363 RPC, rigorous imprisonment for one month for the commission of offence under section 343 RPC. The convicts Chottu Ram is sentenced to rigorous imprisonment for one month for the commission of offence under section 343 RPC. All the sentences shall run concurrently. |
