| Court awards life-imprisonment to wife for murdering husband | | | early times report Jammu, July 31: Additional Sessions Judge Udhampur MK Sharma today awarded life-imprisonment to Bimla Devi widow of Babu Ram of Kirmoo Morha Nambla Tehsil Ramnagar for murdering her husband by strangulating him. According to the prosecution on 27 September 2007 at about 8.45 AM an information was received in police station Ramnagar that body of Babu Ram alias Premu was found hanging from a tree. Since the deceased had died under mysterious circumstances inquest proceedings u/s 174 Cr.P.C were initiated by ASI Inder Singh. After postmortem the clothes of the deceased were seized and the body was handed over to Mulkh Raj brother of the deceased for performing last rites. Report of viscera was obtained in SDH Ramnagar from FSL Jammu. It was opined that the death was due to strangulation. Accused Bimla Devi was arrested as suspect u/s 54 Cr.P.C who during interrogation disclosed that she along with co-accused Suram Chand with common criminal intention gagged the deceased Babu Ram strangulated with 'dupatta' and thereafter hanged the body with a rope on tree. The Court after hearing Anil Vijay Kumar for the accused and APP Tariq Mujahid Mughal for the state observed that prosecution has succeeded in proving that the accused strangulated her husband to death with a dupatta and tried to imitate the death as suicide by suspending the body from a tree near her house. "The accused is therefore convicted for the commission of offence u/s 302 RPC whereas guilt against the other accused Suram Chand for the same charge has not been proved who is accordingly acquitted of the charges," the judge said. The Court awarded imprisonment for life and fine of Rs 5000 for the commission of offence u/s 302 RPC to Bimal Devi for committing the murder of her husband. (JNF) |
