| Court denies bail to two in murder case | | | Early Times Report
JAMMU, May 31 (JNF): Principal Sessions Judge Bahderwah M.K.Sharma today rejected the bail applications of Zahid Hussain son of Abdul Latief resident of Bharthi tehsil Gandoh and Manzoor Ahmed son of Abdul Latief resident of Chilli Tehsil Gandoh who were facing trial in murder and kidnapping case. Principal Sessions Judge Bhaderwah M.K.Sharma observed that accused Zahid Hussain and Manzoor Ahmed have been sent to trial by the police of PS Gandoh in Crime No. 64/2004 for the commission of offences under sections 302/120-B/364 RPC & 7/27 Arms Act with the allegations that on 09-07-2004, the accused alongwith other accused persons kidnapped the deceased Liyaqat Ali Khan while he was coming home from Gwari Dhar, murdered him and threw the dead body in Nagroldi nallah. Court further observed that in the instant case, accused have been charge sheeted for the commission of offence punishable u/s 302 RPC which carries punishment of death or imprisonment for life and fine. They are neither under the age of 16 years, nor sick or infirm persons. The trial is still in progress. Evidence adduced by the prosecution cannot be appreciated at this stage because it may prejudice any of the parties to the case but on going through the evidence on record it cannot be said that there are no reasonable grounds for believing that the accused have not committed the offence of which the accused are charged. With these observations Court rejected the bail application of both the accused persons. |
