DB commutes lifer to three in murder case 6/18/2014 12:13:05 AM Early Times Report Jammu, June 17 : A Division Bench of State High Court Comprising Justice Virender Singh and Justice BL Bhat has convicted the three accused from 302 to 304-II and awarded 10 years imprisonment instead of life-imprisonment awarded by Trial Court. According to the police case, on September 19, 2004 a written report filed by Daleep Singh s/o Dharam Chand r/o PhaltiMitra Tehsil Ramban accompanied by others alleging therein that on September 18, 2004 his brother Bir Singh alias Munna was called from his house by Gian Singh and took him to market; that he did not return late night and at the mid-night his other brother Chain Singh came to his house and told that Gian Singh had accused Bir Singh of stealing Rs 2300/- and had taken him to his house where Jasbir Singh and KasturiLal were also present who had confined him in a room and were investigating the theft; that Bir Singh did not confess to theft and all the three took him out from room and after tying with a rope he assaulted by Gian Singh with a sitick and Jasbir Singh with a Spade on his head and other delicate parts with an intention to kill him as a result of which he was grievously injured resulting into his death. Police registered a case and after completion of investigation presented challan in the Court of law. On September 29, 2012, Trial Court awarded life imprisonment to three accused namely Gian Singh s/o IsharDass Thakur, Jasbir Singh s/o Gian Singh Thakur both residents of PhaltiMitra Tehsil Ramban and KasturiLal s/o IsharDass Thakur r/o Village Kanga Tehsil Ramban. Division Bench after hearing both the sides set aside the conviction of accused under Section 302 RPC and instead, convict them under Section 304 Part II read with 34 RPC and awarded 10 years imprisonment to Gian Singh s/o IsharDass Thakur, Jasbir Singh s/o Gian Singh Thakur both residents of PhaltiMitra Tehsil Ramban and KasturiLal s/o IsharDass Thakur r/o Village Kanga Tehsil Ramban.   Share This News with Your Friends on Social Network     Comment on this Story
