Chatta-Sunjwan Land Scam: DB directs State to submit details of ATR

Jammu, Aug 5: In a petition allegedly hushing up of a land scam pertaining to Government Land at Village Chatta, Sunjwan, Tehsil and District Jammu which was treated by the High Court as Public Interest Litigation(PIL), a Division Bench (DB) of state High Court comprising Justice Dhiraj Singh Thakur and Justice Bansi Lal Bhat issued notice to State and ors and notices accepted by the counsel for the State on behalf of respondents.
Division Bench directed respondents to file response within four weeks and the respondents shall also submit details of the action taken pursuant to Govt Order No 05-GAD of 2008 dated January 1, 2008 whereby Divisional Commissioner Jammu had been appointed as an Enquiry Officer to indetify the officials responsible for affecting mutation of state land in favour of private parties.
Division Bench directed the response must give the details of the progress made by the Enquiry officer pursuant to his appointment.
The respondents shall also submit as to whether it has been taken to its logical conclusion and if not, the reason for the same and directed Registry to list this PIL on September 8, 2014.
The petitioner highlighting the hushing up of a land scam pertaining to Government Land at Village Chatta, Sunjwan, Tehsil and District Jammu. The petitioner was fully convinced that no enquiry was conducted by Sudhanshu Pandey (IAS) the then Divisional Commissioner, Jammu pursuant to Govt. Order dated 01-01-2008 and a major land scam was hushed up for conferring undue benefit upon a influential colonizer i.e. SRK Associates.
Not only this erring officials responsible for various acts of omission and commission escaped from the dragnet of law due to the non-holding of enquiry in the matter. The matter was pertaining to encroachment of the Govt. Land and looking into the seriousness of the allegations the respondent No.2 had appointed the then Divisional Commissioner, Jammu as inquiry officer but the whole scam was hushed up/buried for the reasons best known to the respondents herein.
In order to lift the veil and to inspire confidence in the probe, the matter is required to be entrusted to CBI as the State machinery connived with the colonizer for stalling the enquiry and thus a time bound probe is need of the hour so that the guilty are identified and punished in accordance with law.
Petitioner also seeking direction to respondents to identify the officers/officials who were instrumental in not giving effect to Govt. Order No.05-GAD of 2008 dated 01-01-2008 and also seeking direction to respondents for CBI probe in this matter. (JNF)
