| 10 yrs RI awarded to accused in abduction, rape bid with minor | | | Jammu, Aug 5: Presiding Officer Fast Track Court Sanjeev Gupta today awarded 10 years rigorous imprisonment to one Ashwani Kumar who was facing trial in kidnapping and rape attempt with a minor girl of barely five years. After hearing APP GS Charak appearing for the State whereas Adv DS Saini appearing for the accused Presiding Officer Fast Track Court Sanjeev Gupta observed that the rape case and cases relating to crime against women pertaining to girl children have increased in recent time as in present case when it relates to a helpless girl of five years of age cannot be lost sight and per se it requires exemplary treatment. With these observations Court granted seven years rigorous imprisonment and fine Rs 25000 u/s 376/511 RPC and u/s 363 Court awarded three years and fine Rs 2000 to Ashwani Kumar. Court further directed that if the fine amount be released than Rs 20000/- shall be given to the prosecutrix as compensation. According to the police case on November 29, 2010, prosecutrix a small girl of five years age along with her mother had to gone to Badyala Chak to attend marriage function, celebration started at about 8:00 pm meanwhile accused with a criminal intention, lured the prosecutrix with an offer of toffees from the nearby shop and took the girl to the fields outside the village in dark where he committed crime upon her. The prosecutrix started crying at which accused tried to frightened her, however when she was about to become unconscious due to the act of the accused, accused out of fear brought her back to the village and left her near her house after giving threat of life by saying not to disclose the incident to any person. The prosecutrix narrated the entire incident to her mother who immediately took her to Police Station Akhnoor where a written report was lodged and case u/s 363/376 RPC was registered and after completion of investigation challan was presented and charges u/s 363/376/511 was framed against the accused person.
