JAMMU, Nov 5: With 'illegally appointed officials' busy in playing musical chairs and selling their proximity with President of BCCI Anurag Thakur via social networking websites, Supreme Court (SC) has virtually put a freeze on Board of Control Cricket for India (BCCI) from releasing funds worth crores of rupees to Jammu and Kashmir Cricket Association (JKCA).
The officials spend half of their time in getting photographs clicked with BCCI President Anurag Thakur and rest in advertising their contacts via social networking websites. Having managed their entry in the Jammu and Kashmir Cricket Association (JKCA), the officials do not even ponder for few minutes about getting the funds released and subsequently, about the failure of cricket team of Jammu and Kashmir in improving their performance at the national level.
On a day when Supreme Court directed BCCI to furnish the report obtained from Deloitte on Jammu and Kashmir Cricket Association (JKCA) as well as any undertakings submitted within 5 days, the members of JKCA preferred not to even issue a customary handout clarifying the whole issue but were seen enthusiastically tweeting about BCCI President's latest statement. Not even a word was heard from the President of JKCA Imran Raza Ansari nor from the other office bearers.
A source said that once BCCI submits the Deloitte report before the Supreme Court, the release of funds is likely to get further delayed since the report contains detailed account of wrongdoings of the JKCA officials and shows how the office bearers of JKCA used funds meant for promotion of cricket for their personal growth. He added that crores have gone down the drain during the last two decades. Ex-Chief Minister Dr. Farooq Abdullah was head of JKCA during all these years.
Sources further said that the report is likely to expose several office bearers of JKCA who are claim of being saints in their public life. They added that Deloitte report is likely to put several JKCA officials in deep trouble. Sources further disclosed that the probe which is going on should have by now sealed the fate of several members of JKCA but the same has not happened so far. Once the Deloitte report becomes public, sources said that probe into multi-crore JKCA scam is likely to speed-up.
Not only Deloitte report, Supreme Court (SC) has also said that the question of release of funds to Jammu and Kashmir Cricket Association (JKCA) is also governed by Para 20(I) of Supreme Court's order dated July 18, 2016. This makes the release of funds extremely difficult since Para 20(I) of Supreme Court's order dated July 18, 2016 says that Board of Cricket Control of India (BCCI) shall forthwith cease and desist from making any disbursement of funds for any purpose whatsoever to any state association until and unless the state association concerned adopts resolution undertaking to implement recommendations of committee as accepted by Supreme Court (SC).
The directions further adds that after such a resolution is passed and before any disbursement of funds takes place to the state association concerned, a copy of the resolution shall be filed before the Lodha committee as well as Supreme court, together with an affidavit of the President of the state association undertaking to abide by the reforms contained in the report of the Committee, as modified by this Court.
The order ends by saying that any transfer of funds shall take place to the state associations which have complied to these terms. The terms include deletion of all provisions enabling holding of posts in the JKCA for more than 9 years, restriction of Office Bearers to only the following five posts: President, Vice President, Treasurer, Secretary and Joint Secretary; Delete provisions for all other posts, amendment of the term/tenure of Office Bearer to be 3 years, Insertion of a cooling-off clause, which bars previous office bearers either at the BCCI or the state association from contesting the succeeding office bearer elections or having a second consecutive term, amendment to the composition of the governing body to include at least one woman, representatives of the players and a nominee of the Accountant General of the state and amendment to the Membership clause to automatically grant membership to interested former international cricketers from the State provided they have not already opted for membership of another Association.
The terms further include insertion of a clause barring voting by proxy, insertion of disqualifications from being an Office Bearer as stated in Rule 14(3) of the Rules read with the Judgment of the Supreme Court, insertion of Clauses for appointment and functioning of the Ombudsman, Electoral Officer and Ethics Officer. These may be in line with Rules 40-41, 32-33 and 38-39 of the proposed BCCI Rules, insertion of provisions for transparency as per Rules 34-36 (financial) and 37 (others) of the proposed BCCI Rules as well as Pages 76-77 of the Report, insertion of a provision that removes the social club (if any) from the management and control of the association and adoption of the agents registration norms as applicable to players in states. With these stipulations and JKCA's attitude of not accepting the directions, players are likely to face the heat.
