Man booked for raping wife after seeking divorce

Jammu, May 28: Following the directions passed by Judicial Magistrate First Class (JMIC), Akhnoor, a rape case was registered against a man for allegedly raping his wife during separation period after seeking divorce at Akhnoor police station.
"I deem it proper to direct the Station House Officer (SHO) Akhnoor to register FIR and conduct the investigation as per law and under rules", reads the order passed by the Judicial Magistrate First Class (JMIC) Akhnoor.
Acting on the orders, a case under FIR 106/18 under section 376A of RPC has been registered in Akhnoor police station against the accused of Dhoun Chak Khour.
Sources said that the complainant in her complaint alleged that she was married to the accused on November 28th of 2010 at village Sungal of Akhnoor and has given birth to two sons one of them is specially challenged following which her husband started treating her with cruelty resulting the complainant approached the court of Akhnoor in the beginning of the year of 2017 for seeking monthly maintenance.
"My husband played fraud with me by filing a petition under section 15 of Hindu Marriage Act for seeking mutual divorce but I had not even read the petition filed under section 15 of the Hindu Marriage Act and I was misinformed by the counsel also", alleged complainant.
The complaint further reads that she Dogri knowing persons, could not read the statements as they were recorded in Urdu language and the statements were not explained to her in the language which she understands while parents of the complainant were also not informed about the petition.
"On 23-10-2017, the court allowed the petition and passed a decree declaring the marriage of the complainant and the accused to be dissolved", the complaint reads adding that from 7-3-2017 till 23-10-2017 (cooling off period), the accused kept on developing physical relations with the complainant and it making her believe that they are husband and wife whereas they ceased to be husband and wife on 23-10-2017.
