PIL regarding shifting of Mobile Towers

Jammu, July 27: In a Public Interest Litigation filed by Navyug Sethi a law student seeking direction to respondents to issue appropriate directions to all those Telecom companies to shift/re-locate their Mobile Transmitting Towers from the residential areas to such places/areas which have been specifically earmarked and specified for installation of Mobile Transmitting Towers as per the guidelines issued by the Jammu Municipal Corporation, within such time as may be determined by this Court so that the residents having their residential houses/ establishments are saved from suffering serious diseases like cancer, sleep disorders, fatigue, headache, memory loss, depression, hearing problems, joint pains, skin diseases, and even cardiovascular problems which are inevitable because of radiation emitted by these towers.
A Division Bench of State High Court Comprising Acting Chief Justice Alok Aradhe and Justice Sanjay Kumar Gupta after hearing Sr. Adv Sunil Sethi with Adv Sumit Nayyar for the PIL, directed Commissioner JMC to appear in person on August 1, 2018 to explain as to why the orders have not been passed pursuant to the show-cause notice issued to various persons who had erected mobile towers unauthorizedly.
When the PIL came-up for hearing, Division Bench observed that this Court by an order dated 18.05.2018 had directed the Municipal Corporation, Jammu to take an action against the companies whose mobile towers have been found to be installed unauthorizedly, in accordance with law and to submit a compliance report. The compliance report has been filed on behalf of the Municipal Corporation, Jammu, in which, it is stated that notices have been issued to various persons, whose mobile towers have been installed unauthorizedly and their replies have also been received.
DB after going through the status report observed that the status report is silent with regard to action taken by the Municipal Corporation, Jammu in this regard and directed Commissioner, Municipal Corporation, Jammu to appear before this court on 01.08.2018 to explain as to why the orders have not been passed pursuant to the show-cause notice issued to various persons who had erected mobile towers unauthorizedly.
