Early Times Report

Jammu, July 28: In a Public Interest Litigation filed by Ghulam Rasool Magrey seeking directions to the respondents to prevent environmental degradation and deforestation by construction of eleven hydro electric power projects in a highly Seismic sensitive zone of Kisthwar.
A Division Bench of State High Court Comprising Acting Chief Justice Alok Aradhe and Justice Sanjay Kumar Gupta after hearing Adv Pranav Kohli appearing for the PIL issued notice to Union of India through Secretary Ministry of Environment and Forest, Central Pollution Control Board, State of Jammu & Kashmir through Secretary Ministry of Environment and Forest, J&K Pollution Control Board, J & K State Power Development Corporation, Chief Conservator Forest J&K and Chenab Valley Project Through Managing Director.
Notices on behalf of Union of India accepted by ASGI, on this Court grants four weeks time to file response.
During the course of hearing Adv Parnav Kohli appearing for the PIL also seeking direction to the respondents to protect environment, forest, wild flora and fauna which is under serious and imminent threat due to un-mindful construction of 11 (eleven) hydro electric power plants without complying to the provisions of the Environment (Protection) Act read with the rules as framed therein in Kishtwar region of Kashmir.
He further submitted that being a responsible citizen, it is the fundamental duty of the petitioner to project the cause of the general public of District Kishtwar, caused by the Construction of the Hydro Electric Power Projects at such great number (Eleven) in a high seismic zone in the valley of Kishtwar will cause great environment damage to the natural wild life in thousands hectares of land which are home to some thousand of rare species of bird, animals including natural flora and fauna. With the construction of (Eleven) hydro electric power projects will put the entire valley at risk. Kishtwar valley being in the High Seismic Zone-IV, is expected to experience earthquakes of intensity of more than 8 on Richter Scale. With the commissioning of the hydro electric power plants, the entire valley will be at greater risk of getting submerged in the water, which will cause great causality not limiting to property but human as well.
